This action is part of a wider effort to expand the domestic use of the armed forces in multiple urban centers under Democratic control.

Court Fight Over Guard Activation

In an emergency filing, the federal legal authorities urged the bench to reverse a previous judicial decision that had stopped the deployment of a few hundred state guard troops to the Chicago region.

The district judge had raised doubts about the White House's explanation for sending troops, doubting its reasoning in light of local conditions.

A higher court affirmed the previous order on midweek, keeping the activation on hold while the legal challenge moves forward.

White House's Claims

The top government lawyer, representing the White House, stated in the latest petition that government officers have frequently been “intimidated and attacked” in downtown Chicago and the outlying area of Broadview community.

This location is home to an Immigration and Customs Enforcement holding center.

The commander-in-chief has previously deployed military reserve forces to the Windy City and Portland, Oregon, after previous sendings to LA, Memphis, and the nation's capital.

The administration has argued that military intervention is required to curb unrest and strengthen border control.

Partisan Resistance

Opposition leaders have strongly opposed the decision, arguing that the White House's statements are inflated and driven by politics.

They charge the former president of exploiting his power to retaliate against critics.

Court officials have also voiced skepticism about the government's portrayal of ongoing incidents.

Local leaders state that rallies over immigration enforcement have been largely modest and peaceful, contrasting with the president’s description of “battlefield” situations.

Statutory Grounds

At the core of the legal battle is the government's invocation of a national law authorizing the commander-in-chief to federalize the national guard only in cases of uprising or when “powerless with the standard military to enforce the statutes of the US”.

The government argues that the personnel are essential to protect federal property and agents from demonstrators.
